§ 12996 Pesticide Violation Penalties

This law says breaking pesticide rules can get you fined or jailed. If you do it again or hurt people/environment, the punishment is worse.

Key Takeaways

  • •First-time pesticide rule breakers face fines ($5K–$50K) or jail (up to 6 months).
  • •Repeat offenders or those harming health/environment get bigger fines ($15K–$100K) and longer jail time (up to 1 year).
  • •Each mistake counts as a separate crime—so multiple fines/jail terms can add up.

Example

A farmer sprays banned pesticides on crops.

The farmer could be fined $5,000 to $50,000 or jailed for up to 6 months. If the pesticides make people sick, the fine jumps to $15,000 to $100,000 and possible jail time increases.
