§ 12975 Recommendation Liability Limitation

This law says if someone writes down advice, they aren't responsible if people don't follow it.

Key Takeaways

  • •If you give advice in writing, you're not forced to make sure people listen.
  • •You can't be blamed if someone ignores your written advice.
  • •This only applies to written advice, not spoken words.

Example

A doctor writes a note saying you should take medicine twice a day.

If you don't take the medicine and get sick, the doctor isn't in trouble just because they gave you the advice.
