§ 12882 Pesticide Misbranding Violations

This law says it's illegal to sell pesticides if the package is tampered with, the product is worse than promised, the weight isn't clearly labeled, or the label doesn't match the approved one.

Key Takeaways

  • •You can't replace or remove stuff from a pesticide package and sell it.
  • •The product must be as good as the label says.
  • •The weight or amount must be clearly written on the package.
  • •The label must match the one approved by the government.

Example

You buy a bottle of bug spray that says it kills 100 types of bugs, but it only kills 50.

The bug spray is misbranded because it doesn't do what the label promises.
