§ 12649 Enforcing Section 12648 Orders

This law lets the director go to court to stop someone from breaking or about to break an order that was already made.

Key Takeaways

  • •The director can sue to block a violation or a threat of violation of an order.
  • •The court can issue an injunction without needing proof of actual damage.
  • •The court can also force the person to do exactly what the original order requires.

Example

A city orders a factory to stop dumping waste into a river. The factory keeps dumping, so the director files a lawsuit to make the factory stop.

The director can ask the court to order the factory to stop dumping right away, even if no one has been hurt yet, and the court can also tell the factory exactly what it must do to follow the original order.
