§ 12603 Produce Hold Order Compliance

This law says that any food that has a hold order must stay exactly where it is until the director decides what to do with it.

Key Takeaways

  • •Hold‑ordered produce must stay put until the director gives instructions.
  • •The owner or the person holding the produce can still inspect it.
  • •A small sample can be taken for evidence, but only while a director‑chosen person watches.

Example

A grocery store gets a notice that a batch of apples might be unsafe, so they have to keep those apples on the shelf and not move them to another part of the store.

The store must leave the apples where they are until the director tells them otherwise, but they can still look at the apples or take a small piece for testing while a director‑appointed person watches.

§ 12603 Produce Hold Order Compliance

Any lot of produce for which a hold order or notice is issued shall be held by the owner or bailee of the produce and shall not be disturbed or moved from the place where it is, except under the specific direction of the director, pending final disposition pursuant to this chapter. This does not prevent the owner or bailee from inspecting any produce so seized, nor from taking therefrom, in the presence of a person designated by the director, a reasonable sample for evidence. (Enacted by Stats. 1967, Ch. 15.)
