§ 11892 Civil Penalty Option

This law says that if someone breaks a rule, the state can go after them with a civil lawsuit or a fine instead of charging them with a crime.

Key Takeaways

  • •Violations can be handled as civil cases, not criminal ones.
  • •The director can bring a civil lawsuit under sections 11893 and 11894.
  • •The commissioner can impose civil fines under section 12999.5.

Example

A factory ignores a safety regulation and a worker gets hurt.
