§ 10496 Owner Costs Brucellosis Testing

If a livestock owner can't get rid of brucellosis in their herd, they have to pay for the required testing for up to two years (or a little longer if the herd is adult‑vaccinated), unless they are getting special indemnity payments.

Key Takeaways

  • •Owner must cover testing costs after 24 months if brucellosis isn’t eradicated.
  • •If the herd is officially adult‑vaccinated, the testing‑cost period extends to 28 months.
  • •If a hold order existed before this law took effect, the clock starts from the law’s effective date (24 or 28 months).
  • •Owners receiving continuation of indemnity payments are exempt from this rule.

Example

A farmer’s cows test positive for brucellosis. The state tells the farmer to stop moving the herd (a hold order). After two years the farmer still hasn’t cleared the disease.

Because the disease isn’t gone, the farmer must keep paying for the state‑required tests for the rest of the 24‑month period (or 28 months if the cows were adult‑vaccinated). If the farmer had been receiving indemnity payments, this rule wouldn’t apply.
