§ 10359 Brucellosis Vaccination Mark Protection

This law says you can't buy, keep, or use a fake tag or tattoo that looks like the official cattle vaccination mark, unless you are a government officer or an accredited veterinarian.

Key Takeaways

  • •Only federal, state, county, municipal officers or accredited veterinarians may have or use these imitation marks.
  • •The illegal items are any devices that make a mark, stamp, or tattoo that looks like the official cattle vaccination tag for brucellosis.
  • •Buying, possessing, or using such fake marks is a crime.

Example

A rancher buys a counterfeit tag that looks just like the USDA tag used for cattle vaccinated against brucellosis and puts it on his herd to make buyers think the animals are vaccinated.

Because the tag is a fake that mimics the official mark and the rancher is not a government employee or a vet, the law says he is breaking the rule.
