§ 10068 Tuberculosis Indemnity Exclusions

This law says you won’t get any money back for a cow that tests positive for tuberculosis if certain things happen, like breaking the rules or not cleaning up.

Key Takeaways

  • •No payment if a cow reacts to a TB test within 90 days of being brought into the area.
  • •No payment if the cow was brought in illegally or against USDA rules.
  • •No payment until the farm where the cow was kept is cleaned and disinfected as approved by officials.
  • •No payment if the reacting cow isn’t slaughtered within 30 days of being evaluated.
  • •No payment for animals owned by federal, state, or local governments.
  • •No payment if the owner broke any TB‑area rules or related regulations.

Example

A farmer moves a cow into a tuberculosis control zone. The cow tests positive within 90 days, the farmer doesn’t clean the barn, and the cow isn’t slaughtered within 30 days.

Because the cow reacted to the test so soon after arrival, the barn wasn’t cleaned, and the cow wasn’t killed in time, the farmer cannot receive any indemnity payment.
