§ 1603 Deed Conveyance Evidence Presumption

Key Takeaways

  • •If a paper says you own a house or land, and it's signed by the right person and filed with the county, it's usually enough to prove you own it.
  • •This paper is called a 'deed' and it shows who the property was given to.
  • •If someone says the deed is wrong, they have to prove it—it's not up to you to prove the deed is right.

Example

You buy a house, and the seller gives you a deed that's signed and filed with the county.

If someone later says you don’t really own the house, they have to prove the deed is fake or wrong. The deed itself is enough to show you own it unless they can prove otherwise.
