§ 1225 Declarant Statements In Civil Actions

Key Takeaways

  • •If someone says they own something, their words can be used against them later in court.
  • •This applies when someone is trying to prove they own or have a right to something.
  • •The statement must have been made when the person was supposed to own or have the right to the thing.

Example

Imagine you say, 'This bike is mine,' but later someone else claims it’s theirs.

Your earlier statement can be used in court to show you thought the bike was yours at that time.

§ 1225 Declarant Statements In Civil Actions

When a right, title, or interest in any property or claim asserted by a party to a civil action requires a determination that a right, title, or interest exists or existed in the declarant, evidence of a statement made by the declarant during the time the party now claims the declarant was the holder of the right, title, or interest is as admissible against the party as it would be if offered against the declarant in an action involving that right, title, or interest. (Enacted by Stats. 1965, Ch. 299.)
