§ 1200 Hearsay Evidence Admissibility

Key Takeaways

  • •Hearsay is when someone repeats what another person said, but that person isn't in court to say it themselves.
  • •Most of the time, hearsay isn't allowed in court because it's not fair to believe something if you can't ask the person who said it.
  • •The rule is called the 'hearsay rule' and it helps make sure people tell the truth in court.

Example

Your friend tells you that they saw someone steal a bike, but they don't come to court to say it themselves. You try to tell the judge what your friend said.

The judge won't let you tell what your friend said because it's hearsay. Your friend needs to come to court and say it themselves so everyone can ask them questions.
