§ 18660 False Petition Affidavits

This law makes it a crime to lie on a petition about a ballot measure and can result in fines or jail time.

Key Takeaways

  • •Lying on any initiative, referendum, or recall petition is a crime.
  • •People who knowingly help spread false statements on those petitions can also be punished.
  • •Penalties include a fine of up to $5,000, up to one year in county jail, or both.

Example

A neighbor signs a petition to recall the city council member but claims they live in the district when they actually live outside the area. The volunteer who collected the signatures knows the statement is false and files the petition anyway.

Because a false statement was made on a recall petition and the volunteer knew it was false, the law says they can be fined up to $5,000, jailed up to one year, or both.
