§ 18575 Unauthorized Election Officer Duties

This law says it's a serious crime (a felony) to work as an election official or do election duties like counting ballots if you haven't been officially appointed and qualified.

Key Takeaways

  • •You must be officially appointed and qualified before acting as an election officer.
  • •Doing any election work (handling, counting, or checking ballots) without that appointment is a felony.
  • •If convicted, the punishment is 2‑4 years in prison.

Example

A neighbor volunteers to count the votes at the local polling place even though they were never appointed as a ballot counter.

Because they weren't officially appointed, the law treats that as a felony, and they could be sent to prison for two to four years.
