§ 18304 Misusing Government Seals In Campaigns

This law makes it a crime to use a county or local government seal in campaign flyers or mailings if you’re trying to trick voters.

Key Takeaways

  • •Using a county or local government seal in campaign material with the goal of deceiving voters is a misdemeanor.
  • •If the seal makes people think a public official approved the document, that counts as intent to deceive.
  • •“Local government agency” includes school districts, special districts, and any local board or commission.

Example

A candidate prints a mailer that has the county seal on it to make it look like the county government officially supports them.

Because the seal is being used to give a false impression of official approval, the candidate would be breaking this law and could be charged with a misdemeanor.
