§ 10225 Incumbent Nomination Deadline Extension

This law says if the current city officer doesn't turn in their nomination papers (or pulls them back) by 88 days before the election, voters get extra time—until 83 days before the election—to pick a different candidate.

Key Takeaways

  • •Nomination papers for the incumbent must be filed by the 88th day before the election.
  • •If they aren't filed or are withdrawn by that date, voters can nominate someone else until the 83rd day before the election.
  • •The rule doesn't apply if there's no incumbent, and any candidate can withdraw their own nomination paper up to the 83‑day deadline.

Example

The city mayor wants to run again but forgets to file the nomination papers by the 88‑day deadline.

Because the mayor missed the deadline, the city’s voters can submit a new name for mayor up until the 83‑day deadline, and any new candidate can still drop out of the race until that same 83‑day point.

If this section is applicable, notwithstanding Section 10224, a candidate may withdraw their nomination paper until the 83rd day before the election during normal business hours, as posted.
