§ 10005 Voter Id Prohibition

This law says local cities and counties can't make you show ID just to vote or hand in a ballot unless a higher state or federal rule says they must.

Key Takeaways

  • •Local governments (cities and counties) cannot require ID for voting or ballot submission.
  • •The rule only applies if a state or federal law already says ID is needed.
  • •It covers any place where ballots are cast or turned in, like polling places or vote centers.

Example

Maria goes to her town's polling place to vote and the clerk asks her for a driver's license before she can cast her ballot.

Because of this law, the town cannot ask for Maria's ID unless a state or federal law specifically requires it, so the clerk must let her vote without seeing her license.
