§ 10004 Special District Election Failure

If a special district doesn't set up its regular election for board members, the county supervisors can order a special election within 90 days, and the district has to pay for it.

Key Takeaways

  • •County supervisors can step in when a district fails to hold its regular election.
  • •A voter in the district must notify the supervisors about the problem.
  • •The special election must be held no later than 90 days after it’s called.
  • •The election is run the same way as a regular district election.
  • •The district that needed the election pays all the costs.

Example

A small fire‑protection district forgets to schedule its board election. A resident calls the county supervisors and tells them about the missed election.

The supervisors can then call a special election for the board seats, hold it within 90 days, run it just like a normal election, and the fire‑protection district will pay the election costs.
