§ 59125 Student Financial Assistance Certification

Key Takeaways

  • •If a parent or guardian can't afford school-related costs like clothes, transportation, or medical care for their child, they can ask a court for help.
  • •The court will check if the family really can't pay, and if true, they'll give a certificate to confirm it.
  • •The school superintendent can also ask the court for this certificate if they see the family struggling.

Example

A single mom can't afford glasses for her son, who needs them to see the board at school.

The mom can go to court and explain she doesn't have the money. If the court agrees, they'll give her a paper saying she doesn't have to pay, and the school will help cover the cost.

§ 59125 Student Financial Assistance Certification

If the parent or guardian of any pupil in the school is unable either himself or from the estate of the child to clothe the child, or pay for its transportation to and from school, or for necessary dental work, eye care, operations, and hospitalization of the child while at the school, or is unable either himself or from the estate of the child to reimburse the Department of Education for expenses incurred by it in providing dental work, eye care, operations, or hospitalization for the child in an emergency, the parent or guardian may apply for a certificate to that effect to the superior court of the county of which the parent or guardian of the child is resident. If the court is satisfied that the parent or guardian either himself or from the estate of the child is unable to pay for any such service, it shall issue a certificate to that effect. The application for the certificate may also be made to the court by the superintendent of the school. (Enacted by Stats. 1976, Ch. 1010.)
