§ 49407 Emergency School Medical Treatment

Key Takeaways

  • •Schools and doctors can give medical help to a sick or hurt kid during school if they can't reach the parents.
  • •Parents won't be mad or sue if the school or doctor helps their kid in a reasonable way.
  • •This only works if the parents didn't already say 'no' to medical treatment (except first aid) in writing.

Example

A kid falls on the playground and breaks their arm during school.

The school can call an ambulance and the hospital can put a cast on the arm, even if they can't reach the parents right away. The parents can't get mad or sue if they didn't already say 'no' to this kind of help.
