§ 49334 Employee Immunity For Reporting

Key Takeaways

  • •If a school worker tells the police about someone with a dangerous item at school, they won’t get in trouble for breaking school rules about calling the police.
  • •The worker must still follow the school’s usual steps after telling the police.
  • •This rule is only for when the worker is the first one to tell the police.

Example

A teacher sees a student with a knife at school and calls the police right away, even though the school’s rule says to tell the principal first.

The teacher won’t get in trouble for not telling the principal first because they were trying to keep everyone safe. But after calling the police, the teacher still has to follow the school’s usual rules, like telling the principal next.
