§ 27413 Retirement Benefits Division Rules

Key Takeaways

  • •If a married couple gets divorced or one of them dies, their retirement money from a government job can be split fairly.
  • •The law makes sure that the retirement money isn't taken away just because the person who earned it dies or gets divorced.
  • •This rule only applies to government retirement plans in California.

Example

A husband and wife get divorced. The husband worked for the city and has a retirement plan.

The wife can still get her fair share of the husband's retirement money, even after the divorce. The law makes sure she doesn’t lose that money just because they’re not married anymore.
