§ 27404 Nonparticipant Spouse Benefit Rights

• •If one spouse is not part of a special work savings plan, they usually can't get money from the other spouse's separate savings in that plan.
• •But if the spouse not in the plan works a job that lets them join the plan, they can get their own savings from it.
• •This rule doesn’t stop someone from getting their own savings if they’re part of the plan.

Husband has a special savings plan at work, but wife doesn’t work there. Wife usually can’t take money from husband’s separate savings in that plan.

The wife can’t get money from the husband’s special work savings unless she has her own job that lets her join the same plan.
