§ 23702 Disability Benefit Election Rules

Key Takeaways

  • •If you were part of the Defined Benefit Program on October 15, 1992, and not already getting disability or retirement money, you could choose between two options: keep your old disability and family benefits, or switch to new disability retirement and survivor benefits.
  • •This choice was permanent—once you picked, you couldn’t change your mind later.
  • •Your eligibility was based only on whether you were in the program on October 15, 1992. It didn’t matter if you joined before or after that date or what happened later.

Example

Imagine you were a teacher in 1992 and part of the Defined Benefit Program. You weren’t retired or on disability yet. The law let you decide if you wanted to keep your old benefits or switch to new ones.

If you chose to switch, you’d get different benefits if you got hurt or retired. But you had to decide by the deadline, and you couldn’t go back to the old plan later.
