§ 22665 Nonmember Spouse Service Credit

Key Takeaways

  • •If a court gives some of your retirement points to your ex-spouse, those points can still help you qualify for retirement or disability benefits.
  • •But if those points were from money you took out before or extra work you did, you have to pay that money back first before you can use those points.
  • •Your retirement pay is based on how many points you have in your account when you retire.

Example

John and Mary got divorced. The court gave Mary some of John’s retirement points from his old job. John had taken out some of that money years ago.

John can still use those points to qualify for his retirement, but he has to pay back the money he took out first. When he retires, his pay will be based on the points left in his account.
