§ 22652 Retirement Benefits Division Orders

Key Takeaways

  • •When a couple splits up or gets divorced, the court must write down the date they separated.
  • •The court can split the retirement money earned during the marriage between the two people.
  • •If the retirement money isn't split by the court, it all stays with the person who earned it.
  • •The non-working spouse can get a share of the retirement money or benefits, even if they didn't earn it.

Example

A husband and wife get divorced after 10 years of marriage. The husband has been working and saving retirement money the whole time.

The court will decide how much of the retirement money the wife gets, based on the years they were married. If the court doesn't say anything, the husband keeps all the retirement money. The wife might get some of the retirement payments when the husband retires.
