§ 21198 Petition Statements Deemed True

Key Takeaways

  • •If someone files a petition (a formal request) and the other side doesn’t respond, the court will assume everything in the petition is true.
  • •If the other side does respond but doesn’t argue against specific points, those points will be taken as true.
  • •Not answering the petition at all means you’re agreeing with everything it says.

Example

Your neighbor files a petition saying you built a fence on their land, but you ignore it and don’t respond.

The court will assume the fence is really on their land because you didn’t say otherwise.
