§ 17485 School Playground Preservation

Key Takeaways

  • •Schools can sell extra land they don’t need anymore.
  • •Other government groups can buy this land to keep it as parks or playgrounds.
  • •This helps make sure kids and families still have places to play, even if the school doesn’t own it anymore.

Example

A school has a big empty field they don’t use anymore. They want to sell it, but the neighborhood kids play soccer there every weekend.

The school can sell the field to the city instead of a private buyer. The city can then keep it as a public park so the kids can keep playing soccer there.

§ 17485 School Playground Preservation

The Legislature is concerned that school playgrounds, playing fields, and recreational real property will be lost for those uses by the surrounding communities even if those communities in their planning process have assumed that the properties would be permanently available for recreational purposes. It is the intent of the Legislature in enacting this article to allow school districts to recover their investment in surplus property while making it possible for other agencies of government to acquire the property and keep it available for playground, playing field or other outdoor recreational and open-space purposes. (Added by Stats. 1996, Ch. 277, Sec. 3. Effective January 1, 1997. Operative January 1, 1998.)
