§ 14042 School Funding Warrant Process

This law tells the state money manager (the Controller) how to send money to each county when the school chief (Superintendent or Chancellor) is late in approving the first school money plan.

Key Takeaways

  • •If the school chief is late, the Controller still sends the normal February amount (same as January).
  • •In the month after the late certification, the Controller sends extra money equal to the shortfall caused by the delay.
  • •All money drawn under this rule comes from the State School Fund and isn’t affected by other government fund rules.

Example

The school chief should approve the school budget by Feb. 20, but they wait until March 5. Because they were late, the Controller has to send extra money to the counties in March to make up for the delay.

Since the approval came after Feb. 20, the Controller first sends the normal amount for February (the same as January). Then in March, the Controller sends extra money equal to the difference between what should have been sent if the approval had been on time and what was actually sent in February.

How to Calculate

Extra amount for the month after certification = (Warrants that would have been drawn if certification was on time) – (Warrants actually drawn under subsection (a))

  1. Find the amount the Controller would have sent for each county if the certification had been received by Feb. 20 (this is the amount from Section 14041).
  2. Find the amount the Controller actually sent under subsection (a) – the same amount as the January warrants.
  3. Subtract the amount from Step 2 from the amount in Step 1. The result is the extra money the Controller must send in the month after the late certification.

County X would have gotten $100,000 if the certification arrived by Feb. 20. Because the certification was late, the Controller only sent the January amount of $80,000 in February.

Result: Extra amount for March = $100,000 – $80,000 = $20,000. So the Controller sends $20,000 extra to County X in March.

(a) If the Superintendent of Public Instruction or the chancellor does not certify to the Controller, on or before the 20th day of February, the amounts apportioned by him as the first principal apportionment, the Controller shall draw warrants on the State Treasury in favor of the county treasurer of each county in the month of February, and in each month thereafter until the month following his receipt of such certification, for amounts equal to the warrants drawn for January. (b) In the month following the receipt of the certification of the amounts apportioned by the Superintendent of Public Instruction or the Chancellor of the California Community Colleges as the first principal apportionment, the Controller shall draw warrants on the State Treasury in favor of the county treasurer of each county in an amount equal to the difference between the amount of the warrants which would have been drawn pursuant to Section 14041 had the certification been received by the Controller not later than February 20th and the amount of the warrants drawn pursuant to subdivision (a) of this section. (c) Warrants drawn under this section shall be drawn on the State School Fund and are not subject to the provisions of Government Code Section 925.6. (Amended by Stats. 1979, Ch. 797.)
