§ 9251 Court Power Over Corporate Trusts

Key Takeaways

  • •Courts can sometimes let a company break the rules of a trust or agreement about how they handle money or investments.
  • •This only happens if the court thinks it's the right thing to do in that situation.
  • •The company can't just decide on their own—they need the court's permission.

Example

A company has a rule that they can only invest money in safe things like government bonds, but they see a chance to invest in something riskier that could help them grow and save jobs.

The company can ask a court for permission to break their own rule and invest in the riskier thing. If the court agrees, they can do it even though the rule says no.
