§ 8716 Charitable Trust Asset Disposition

Key Takeaways

  • •When a company with a charity trust closes, its money or stuff must go where its rules say, unless another law says different.
  • •Usually, a court must approve where the charity stuff goes, and the state’s lawyer (Attorney General) must be involved.
  • •The Attorney General can say it’s okay to skip court if they write a note saying they don’t mind.

Example

A small company that helps sick kids closes down.

The company has leftover money meant for charity. Its rules say the money should go to a children’s hospital. The company asks the Attorney General, who writes a note saying it’s fine. So, the money goes to the hospital without needing a court to decide.
