§ 5030 Acknowledgment Of Instruments

Key Takeaways

  • •An 'acknowledged' document means it's officially confirmed by the person who signed it.
  • •This can happen in two ways: either through a formal process with a notary or by signing a written statement saying you are who you say you are and that you signed the document.
  • •If a notary or a court official with a seal confirms your signature outside of California, no extra steps are needed to prove it's real.

Example

You sell your car and sign the title to give it to the new owner.

To make it official, you go to a notary, show your ID, and sign the title in front of them. The notary then adds their stamp, confirming that you really are the person selling the car. This makes the title 'acknowledged' and legally valid.

Any certificate of acknowledgment taken without this state before a notary public or a judge or clerk of a court of record having an official seal need not be further authenticated.
