§ 18310 Membership Termination Rules

This law says a person stops being a member of an unincorporated group when they quit, their membership term ends, they are kicked out, they die, or the non‑person they represent ceases to exist.

Key Takeaways

  • •Membership ends if you resign, your term runs out, you are expelled, you die, or the legal entity you represent ends.
  • •Leaving the group doesn’t erase any debts or promises you made while you were a member.
  • •The group can still sue you or collect money for those old debts even after you’re no longer a member.

Example

Sarah quits a hobby club, but she had already promised to pay $30 for a group trip before she left.

Even though Sarah is no longer a member, the club can still ask her to pay the $30 because she made that promise while she was a member.

(5) Termination of the legal existence of a member that is not a natural person. (b) Termination of membership does not relieve a person from an obligation incurred as a member before termination.
