§ 9611 Secured Party Disposition Notice

Key Takeaways

  • •If someone owes money and the lender wants to sell their stuff (like a car or house) to get the money back, the lender must tell the person who owes money and anyone else who helped promise to pay.
  • •The lender doesn’t have to tell anyone if the stuff is something that goes bad fast (like food) or loses value quickly (like stocks).
  • •The lender must also tell other people who might have a claim on the same stuff, like another bank or someone who lent money using the same thing.
  • •The lender has to ask for info about other claims on the stuff and tell those people too, if they find any.

Example

You borrow money from a bank to buy a car, and your friend promises to pay if you can’t. You stop paying, so the bank wants to sell your car.

The bank must send you and your friend a letter saying they’re selling the car. They also have to check if anyone else, like another bank, has a claim on the car and tell them too. If the car was something like fresh fruit that would rot, they wouldn’t have to send the letter.
