§ 9341 Bank Account Security Interests

Key Takeaways

  • •A bank must treat your account normally, even if someone else claims money from it.
  • •The bank can’t freeze or change your account just because someone else has a claim on it.
  • •The bank can ignore instructions from the person who claims your money, unless they agree in writing.

Example

You owe money to a friend, and they try to take money from your bank account to pay themselves back.

The bank can’t just freeze your account or follow your friend’s orders unless they agreed to it in writing. Your account works like normal.
