§ 9319 Consignee Creditor Rights

Key Takeaways

  • •If someone gives their stuff to another person to sell (like a store), the store can treat that stuff as if it’s theirs when dealing with buyers or people the store owes money to.
  • •The store can sell the stuff like it’s their own, even if it’s not.
  • •If the store owes money to someone, other laws (not this one) decide who really owns the stuff if the original owner had a special claim on it.

Example

You give your bike to a bike shop to sell for you. The shop still owes money to a supplier.

The bike shop can sell your bike like it’s theirs, even though it’s still yours. If the shop’s supplier tries to take the bike because the shop owes them money, other rules decide if they can.

§ 9319 Consignee Creditor Rights

(a) Except as otherwise provided in subdivision (b), for purposes of determining the rights of creditors of, and purchasers for value of goods from, a consignee, while the goods are in the possession of the consignee, the consignee is deemed to have rights and title to the goods identical to those the consignor had or had power to transfer. (b) For purposes of determining the rights of a creditor of a consignee, law other than this division determines the rights and title of a consignee while goods are in the consignee’s possession if, under this chapter, a perfected security interest held by the consignor would have priority over the rights of the creditor. (Amended (as to be added by Stats. 1999, Ch. 991) by Stats. 2000, Ch. 1003, Sec. 13. Effective January 1, 2001. Addition and amendment operative July 1, 2001, by Stats. 1999, Ch. 991, Sec. 75, and Stats. 2000, Ch. 1003, Sec. 56.)
