§ 2714 Buyer Damages For Nonconformity

Key Takeaways

  • •If you buy something and it's broken or not as promised, you can get money back for the difference in value.
  • •The money you get is usually the difference between what the item is worth now and what it should have been worth if it was as promised.
  • •Sometimes, you can also get extra money for other problems caused by the broken item.

Example

You buy a used car that the seller says runs perfectly, but the engine stops working after a week.

You can get money back for the difference between what the car is worth now (with a broken engine) and what it would be worth if the engine worked like the seller said. You might also get extra money if you had to rent a car because yours broke down.

(3) In a proper case any incidental and consequential damages under Section 2715 also may be recovered. (Amended by Stats. 1995, Ch. 91, Sec. 21. Effective January 1, 1996.)
