§ 2508 Seller'S Right To Cure

Key Takeaways

  • •If a seller sends the wrong item, they can try again if there's still time left in the deal.
  • •The seller must tell the buyer they will fix the mistake before trying again.
  • •If the seller had a good reason to think the buyer would accept the wrong item (maybe with a discount), they get extra time to send the right one.

Example

You order a blue bike online, but the seller sends a red one by mistake.

The seller can say, 'Sorry, we'll send the blue one soon!' and still has time to fix it. If they thought you might take the red bike for a little less money, they get a little more time to send the blue one.
