§ 10530 Lessor Incidental Damages After Default

This law lets a landlord get back the extra costs they have to pay when a renter breaks the lease, like paying to stop a delivery or move the rented items back.

Key Takeaways

  • •The rule helps the landlord recover extra costs caused by the renter’s default.
  • •Only reasonable charges, like stopping delivery, transporting, caring for, storing, returning, or disposing of the goods, count.
  • •The landlord must show the costs are directly linked to the renter’s failure to pay.

Example

A restaurant rents a commercial oven but stops paying. The owner has to hire a truck to pick up the oven and store it until a new renter is found.

Because the restaurant defaulted, the owner can claim the reasonable fees for the truck, storage, and any other handling costs as part of the landlord’s damages.
