§ 10514 Lessee Defect Notice Requirements

This law says that if a renter doesn't tell the owner about a problem that could have been fixed, they can't later use that problem to back out of the rental or claim the owner broke the contract.

Key Takeaways

  • •Tell the owner about any problem as soon as you see it so they can fix it.
  • •If you stay silent, you can't later use that problem to avoid paying or cancel the rental.
  • •The rule also applies when both parties are businesses and the owner asks for a written list of defects.

Example

A person rents a car and later notices a small dent but doesn't tell the rental company. When the rental period ends, they try to say the car was defective to avoid paying the rental fee.

Because they didn't mention the dent when they could have fixed it, they cannot later use that defect to cancel the rental or get a refund.

§ 10514 Lessee Defect Notice Requirements

(a) In rejecting goods, a lessee’s failure to state a particular defect that is ascertainable by reasonable inspection precludes the lessee from relying on the defect to justify rejection or to establish default: (1) If, stated seasonably, the lessor or the supplier could have cured it (Section 10513); or (2) Between merchants if the lessor or the supplier after rejection has made a request in writing for a full and final written statement of all defects on which the lessee proposes to rely. (b) A lessee’s failure to reserve rights when paying rent or other consideration against documents precludes recovery of the payment for defects apparent in the documents. (Amended by Stats. 2006, Ch. 254, Sec. 67. Effective January 1, 2007.)
