§ 8560 Prevailing Party Interest Award

Key Takeaways

  • •If you win a court case about a stop payment notice, you get extra money called interest.
  • •The interest starts adding up from the day you first gave the stop payment notice.
  • •The interest rate is the same as the legal rate set by the law.

Example

You did some work for someone and they didn't pay you, so you sent a stop payment notice. You took them to court and won.

The court will make them pay you what they owe plus extra money (interest) for the time they didn't pay you, starting from the day you sent the notice.
