§ 8508 Stop Payment Notice Requirements

Key Takeaways

  • •You must send a warning letter (preliminary notice) before you can stop payment.
  • •You must send the stop payment notice before the deadline to file a lien (a legal claim for unpaid work).
  • •If you don’t do both, the stop payment notice won’t work.

Example

You fixed someone’s roof but they didn’t pay you.

Before you can tell the bank to stop paying them, you must first send a warning letter saying you’re owed money. You also have to send the stop payment notice before the deadline to file a lien (usually 90 days after you finish the job). If you miss either step, the bank won’t stop the payment.
