§ 8462 Lien Enforcement Time Limits

Key Takeaways

  • •If someone sues to enforce a lien (a legal claim on property), they have to go to trial within two years.
  • •If they don’t go to trial in time, the court can dismiss the case.
  • •The court decides whether to dismiss it or not.

Example

A contractor does work on your house but you don’t pay them. They file a lien and sue you.

If the contractor doesn’t take the case to trial within two years, the court can throw out the case, and they can’t force you to pay anymore.
