§ 1587 Proposal Revocation Conditions

This law explains the ways an offer can be canceled before it is accepted.

Key Takeaways

  • •An offer can be canceled by the person making it if they tell the other party they are revoking it before the other side accepts.
  • •It also ends if the time given to accept runs out or a reasonable time passes without acceptance.
  • •If the person accepting hasn't met a required condition, the offer can be canceled.
  • •The offer ends automatically if the person who made it dies or can't make decisions anymore.

Example

A neighbor offers to sell his old bike to a friend, but before the friend says yes, the neighbor calls and says he no longer wants to sell it.

The neighbor's phone call is a notice of revocation, which cancels the offer under rule (a).
