§ 89 Court Authority In Civil Cases

Key Takeaways

  • •Just because a law says a court can do something in a small case doesn't mean it can or can't do the same in a big case.
  • •Just because a law says a court can do something in a big case doesn't mean it can or can't do the same in a small case.
  • •Each type of case (small or big) has its own rules, and you can't assume they're the same just because one law mentions one type.

Example

Imagine you have a small claim in court, like suing someone for $5,000 because they damaged your car. There's a law that says the court can make the other person pay your lawyer fees in small cases like this.

This law doesn't automatically mean the court can also make someone pay lawyer fees in a big case, like a $500,000 lawsuit over a business deal. The big case might have different rules, even if the small case law doesn't say anything about it.
