§ 7035 Specialty Contractor Subcontracting Limits

Key Takeaways

  • •A specialty contractor can't hire more than one subcontractor for the same job unless the subcontractor has real employees (not just independent workers).
  • •If the specialty contractor has a union agreement that covers subcontracting, they can hire more than one subcontractor for the same job.
  • •Breaking this rule can get the contractor in trouble.

Example

A plumbing contractor is hired to fix pipes in a big building. They want to hire two different subcontractors to help with the same plumbing job.

The plumbing contractor can only do this if the subcontractors have their own employees (not just freelancers) or if the plumbing contractor has a union deal that allows it. If they don’t follow this, they could get punished.

(2) The specialty contractor is a signatory to a bona fide collective bargaining agreement that covers the type of work being performed on the single project or undertaking and addresses the issue of subcontracting or subletting. (b) A violation of subdivision (a) shall constitute a cause for disciplinary action.
