§ 6006 Retired Lawyer Inactive Status

Key Takeaways

  • •If you retire from being a lawyer, you can ask to be marked as 'inactive' instead of active.
  • •Inactive lawyers can't work as lawyers, vote in lawyer groups, or hold office in those groups.
  • •If you're inactive but want to work as a lawyer again, you can apply and pay fees to become active.
  • •Even if you're inactive, you're still counted as a lawyer for some important rules in California.

Example

A lawyer named Sarah decides to retire and stop working. She tells the State Bar she wants to be inactive.

Sarah can't practice law, vote in lawyer elections, or be on any lawyer committees. But if she changes her mind later, she can pay fees and apply to start working as a lawyer again.

Active licensees who retire from practice shall be enrolled as inactive licensees at their request. Inactive licensees are not entitled to hold office, vote, or practice law. Those who are enrolled as inactive licensees at their request may, on application and payment of all fees required, become active licensees. Those who are or have been enrolled as inactive licensees at their request are licensees of the State Bar for purposes of Section 15 of Article VI of the California Constitution. Those who are enrolled as inactive licensees pursuant to Section 6007 may become active licensees as provided in that section. Inactive licensees have such other privileges, not inconsistent with this chapter, as the board of trustees provides. (Amended by Stats. 2018, Ch. 659, Sec. 11. (AB 3249) Effective January 1, 2019.)
