§ 5561 Licensee Discipline Time Limits

Key Takeaways

  • •If someone with a license does something wrong, the complaint must be filed within 5 years of the board finding out about it.
  • •But no matter what, the complaint can't be filed more than 10 years after the bad thing happened.
  • •If the complaint is about lying or cheating (like in Section 5579), it must be filed within 3 years of the board finding out.

Example

A doctor makes a big mistake during surgery in 2015, but no one finds out until 2020.

The complaint about the doctor must be filed by 2025 (5 years after it was discovered), but not later than 2025 (since 10 years have already passed since the mistake).
