§ 2971 Psychology Practice Injunctions

Key Takeaways

  • •Only licensed psychologists can do certain psychology jobs. If someone without a license does these jobs, they can be stopped by a court.
  • •The court can order them to stop immediately if they are breaking the rules.
  • •The court assumes that harm is being done if the unlicensed person continues, so they don’t need to prove it first.

Example

A person starts giving therapy sessions to people but doesn’t have a psychology license.

The court can quickly order this person to stop because they are breaking the law by acting like a psychologist without a license.

§ 2971 Psychology Practice Injunctions

Whenever any person other than a licensed psychologist has engaged in any act or practice that constitutes an offense against this chapter, the superior court of any county, on application of the board, may issue an injunction or other appropriate order restraining that conduct. Proceedings under this section shall be governed by Chapter 3 (commencing with Section 525) of Title 7, Part 2 of the Code of Civil Procedure, except that it shall be presumed that there is no adequate remedy at law, and that irreparable damage will occur if the continued violation is not restrained or enjoined. On the written request of the board, or on its own motion, the board may commence action in the superior court under this section. (Amended by Stats. 1997, Ch. 758, Sec. 41. Effective January 1, 1998.)
