§ 2370 Diversion Program Defamation Protection

Key Takeaways

  • •If you report someone to the board or committee about their behavior in a special program, you can’t get sued for lying (defamation).
  • •This protection is only for reports made to the board or committee, not for random gossip.
  • •The law is there so people feel safe reporting problems without fear of legal trouble.

Example

A nurse reports a doctor to the board because the doctor seems drunk at work and is in a diversion program for addiction.

The nurse can’t get sued for lying (defamation) because the report was made to the right people (the board) and was about the doctor’s behavior in the program.
